This question will appear as a long answer question on the test. You should expect that this question will require about 4-5 paragraphs of explanation/argumentation on your part. You’re expected to read through this article in order to prepare for this question.

Freedom of Expression
In the reading from our text entitled “The Cringing and the Craven: Freedom of Expression in the Workplace,” (page 11) Bruce Barry explains how freedom of expression is often constrained in the workplace and why it is becoming more important as an issue.

Consider the assertion “Freedom of expression in the workplace ought to be more widely permitted than it currently is.”

Provide three arguments that you consider to be compelling in support of that assertion. Each argument should appeal to one of the three ethical theories we have discussed – Utilitarianism, Kantian Ethics and Virtue Ethics. So, you are to provide one argument per normative ethical theory. Each argument should be the best one that can be generated from the corresponding normative ethical theory. Of those three arguments which one provides the best evidential support for the assertion? Explain why.

Freedom of Expression at the Workplace

One of the most sensitive concerns on employment law issues is whether individuals enjoy the freedom of speech at the workplace. Different organizations have different regulations on speech. Often, it depends on whether the organization is a private or public entity. However, the changes in hours of work, laws and technology raises more questions on the importance of freedom of expression at the workplace. Therefore, this paper applies various theories to establish whether freedom of expression at the workplace ought to be more widely permitted than it currently is by providing three arguments considered to be compelling in support of the assertion using three ethical theories– Utilitarianism, Kantian Ethics and Virtue Ethics.

The theory of utilitarianism outlines that any action that leads to maximum happiness and consequences should be considered. John Stuart Mill argues that freedom of expression is an instrumental value in society. He adds that freedom of speech should be protected since it enhances the achievement of a high level of truth in society. Since happiness at workplace results in efficient and effective production, employers should provide greater freedom of expression to workers both at the workplace and society as a whole. From a utilitarian’s perspective, the freedom of expression should be greater in an organization even if an employee expresses a negative opinion about an issue (Kuznicki, 2017, January 3). As long as employees feel happy after expressing an opinion, the level of production would be higher and this benefits the organization. Freedom of expression comes with happiness, with happiness comes satisfaction and motivation. Motivation and satisfaction are key elements in the performance of employees since they drive employees towards attaining the set goals of the organization. Although freedom of expression comes with negative implications at the workplace, its positive impacts cannot be undermined. Hence, employers should allow greater freedom of expression for employees.

Kant proves to be a staunch defender of freedom of expression. He stresses the importance of freedom of expression and what it contributes to society. Kant claims that freedom of speech is the only tool that people have against the sovereign. Through expression, people can discuss and speak against policies that that may have a negative impact on society. The workplace is regulated by a number of policies. Often, the management comes up with policies that are implemented by the employees. Since these policies have a direct impact on employees, there is a need for employers and management to create more room for freedom of expression as this is the better way to speak out on an issue that may affect the organization (Fröding, 2012).

Virtue ethics, on the hand, expresses the connection between freedom of expression and human excellence. It is useful in the protection of individuals’ freedom in any system and checks against excessive use of power in an organization and society. Creation of room for freedom of speech in the workplace builds more trust and truth among employees. Further, it enables employees to be more responsible for their actions and develop a fair mind when making organizational decisions. Form the virtue ethics perspective, greater freedom of speech will enhance mutual respect and understanding in the organization so long as the employees are mature and know what they want. This enhances teamwork and decision making; which are key factors in organizational development.

In summary, although freedom of speech comes with its consequences, its positive impacts cannot be undermined. Freedom of speech enhances coordination, decision-making, happiness and motivation at the workplace. It also enables employees to give opinion on various issues affecting them. Since freedom of expression produces positive results, I support that more room for freedom of speech should be allowed at the workplace.
