Compare and Contrast of State’s Legislative, Executive Branch, and Court System Roles and Influences in Governance

Under the Tenth Amendment to the constitution of the U.S., all powers not issued to the federal administration are reserved for the people and the states. As such, the modeling of all state governments is done after the federal administration and consists of three branches including executive, legislative, and judicial or court system (Tarr, 2003). This paper compares and contrasts Alabama State’s executive, court system, and legislative roles and influences in governance. This paper advances the argument that Alabama State’s branches of the government differ and resemble each other in different aspects of their roles and influences in governance.

The roles of executive, judiciary, and legislative arms of the Alabama government resemble each other in that they contribute to the law making process and creation or approval of law. Nonetheless, these government parts have distinct roles within the process of law making and interpretation. For instance, the executive branch, through the governor, is in charge of coming up with policies, which are then presented to the legislative component of the government for approval (Permaloff & Grafton, 2008). Nonetheless, the executive still possesses the power or mandate to veto laws endorsed by the legislature. Whereas the legislative branch is in charge of creating legislation that transforms into law, the judicial arm or court system is in responsible for interpreting laws established by the legislature. Thus, the court system plays a vital role in determining whether acts of the executive and legislative branches are constitutionally permissible (Spence, 1998). It is significant to note that the legislature is in charge of approving Alabama State’s budget and initiating tax legislation, as well as articles associated with impeachment. This role influences the governing of Alabama State in terms of establishing a system of checks and balances that reflects the federal system and deters the court system and the executive branches from abusing their powers. Another aspect in which the role of the executive, judiciary, and legislature differ is the responsibility of calling out Alabama State’s military forces to preserve the public peace, which is solely reserved to the executive branch.

When it comes to their influences in governance, the legislative, executive, and court system components of the government resemble each other in the sense that they are involved in checks and balances to ensure that no arm of the government acts is excess of its mandate. This influence is attributed to the separation of authority among the three government arms (Tarr, 2003). However, their influences in governance differ from each other in terms of their heads. The legislative branch comprises elected representatives and is headed by the speaker, whereas the executive component is led by a governor, who is directly appointed by the people (Permaloff & Grafton, 2008). On the other hand, Alabama State’s court system is led by the state supreme court. This court is in charge of hearing appeals from state courts within lower-levels.
