Categories of Criminal Defenses
The four broad categories of criminal defenses recognized by the legal system include justification, failure of proof, excusatory, and loss of control or diminished responsibility defenses (Bandaranayake, 2014). Justification defenses include arguments presented on the ground of self-defense and necessity (Bandaranayake, 2014). For instance, a woman might have shot a man who was trying to rape her in a dark lane. In addition, an unskilled worker in a car manufacturing firm might have been asked by a repair mechanic, who was repairing a given robot, to press certain button but mistakenly pressed a start button, which started the robot and killed the mechanic as a result. The unskilled worker may argue that he thought he was doing the right thing as instructed. Failure of proof defenses is application of mistakes and cases of intoxication (Bandaranayake, 2014). The police may fail to prove that the defendant was actually intoxicated when he was caught on drunk-driving offense. Excusatory defenses are applicable confessions that were extracted under duress (Bandaranayake, 2014). For instance, a terrorist suspect might argue that he was forced to confess due through threats, constraints, and violence by the arresting parties. In addition, a murder suspect may, for instance, argue that he was forced at gun point by drug peddlers to shoot and kill his brother or else they were to be murdered both so he chose to lose his brother and survive. Loss of control or diminished responsibility is used as a partial defense and for reducing the charge/sentences in matters relating to murder (Bandaranayake, 2014). For instance, a murder defendant might argue that she/he was suffering from schizophrenia or depression at the time she committed the murder that is under the subject of discussion before the court.
