The constitutional issue in this case was about the second amendment right to bear arms. The constitution provides that a private person has the right to possess a firearm that is “unconnected with service in a militia and to use that arm for traditionally lawful purposes, such as self-defense within the home” (District of Columbia v Heller, 2008, p. 2786). The argument herein was that certain provisions of the District of Columbia Code that illegalized the carrying of unregistered firearm yet prohibited the registration of the same was unconstitutional since it infringed the second amendment right to bear arms (District of Columbia v Heller, 2008). It is important to note that the law also provided that licensed firearms should be kept unloaded and nonfunctional unless they were placed in a place of business or used for legally recognized recreational activities (District of Columbia v Heller, 2008). The question before the court was whether this law violated the second amendment right.
The case was presented before a 9-judge bench. The decision of the court as arrived at by five judges (the majority) was that the law was unconstitutional since it was in violation of the second amendment right to bear arms. One dissenting opinion was expressed by Justice John Paul Stevens who indicated that the right is not absolute and does not effectively curtail the legislature from making additional laws that regulate the practical aspects of the second amendment right (District of Columbia v Heller, 2008). All in all, the conclusion of the matter as per the holding of the court was that the respective provisions of the District of Columbia Code were unconstitutional.
I agree with the majority opinion. I believe the second amendment was meant to protect the people against state sponsored force thus allowing state legislatures to pass contradictory laws is retrogressive.
