Some inmates come into prison with terminal illnesses while others develop terminal illnesses while incarcerated. Please review the article in this week's lesson and discuss the following ethical dilemma.....
Bob is a 60 year old man serving a life sentence in prison for robbery and aggravated assault. He is a habitual offender and is on his third strike. Bob is also terminally ill with lung cancer. The doctors estimate that he has six months to live. His family would like for him to come home where they can care for him until his death.
• Imagine you are a state lawmaker and Bob’s family is requesting that a law be passed to release terminally ill inmates from prison so they can be cared for by their families.
• As a lawmaker are you in favor of such a law?

Law to Release Terminally ill Elderly Inmates
The case of Bob, a 60-year old male serving a life sentence and a habitual offender but who has a terminal illness (lung cancer), lies in the debate on whether incarcerated persons should be released on compassionate grounds. Since Bob has only six months to his death, as a lawmaker, I would favour a law to be passed which requires early release of terminally ill inmates so that they can be taken care of by their families. One of the reasons why I would support such a law is that it is immoral to continue incarcerating people who are in the last months of their lives. The legislation would ensure that human dignity and morality is affirmed in a practical way (Das & Love, 2019). Additionally, the release of the elderly and terminally ill will save the government the complex and expensive medical costs required by the persons. Moreover, a compassionate release would not only uphold the human dignity of the inmates, but also promote medical ethics.
Some people would be opposed to a law that requires release of the terminally ill because they argue that the role of the prison sentence will not be served. Notably, according to Das and Love (2019), one of the main reasons behind imprisonment is retribution and incarceration. As such, opponents of release for the terminally ill argue that such a policy would be inimical to those goals. Additionally, various arguments have been made that serial offenders will likely be a danger to the safety and security of the communities when released in advance. However, such arguments fail to underscore that the individuals are in the last period of their lives; as such, being taken care of by their families is the best way to maintain their dignity. Additionally, for the terminally ill, it is unlikely that they will reoffend considering their health condition.
