Court Systems Discrepancies
Discrepancies in the court system have been there for quite some time experienced at different angles. Such differences on ruling are brought about by various factors such as individuals’ ethnicity, the federal judge, and socio-economic class and where one comes from. In his study, Lartey (2019) argues that discrepancies turn up often when the defendant is a state’s witness or offers assistance to the government. Some are dismissed from the charges against them, yet others get a jail-term reduction. Additionally, in the case study that was carried out in California, 43 states have adopted laws that advocates for juveniles to be tried as adults (Juszkiewicz, 2007).
Just recently, the case of George Floyd vs Derek Chauvin shed light on the kind of the judicial system we have. George Floyd was killed during the arrest by the white police officer. The Ex-police knelt on the neck of Floyd while he was lying face down and handcuffed. The other officers obscured the bystanders from interfering with the arrest. As a result, the family of the deceased filed a lawsuit against the police department and the city of Minneapolis. Chauvin was charged with third-degree murder and second-degree manslaughter. Later on, the crime was upgraded to second-degree murder. The other officers were charged with aiding and abetting the crime. Second-degree murder and aiding and abetting carry a penalty of a maximum of 40 years (Waldrop, 2020).
Chauvin Derek is a former American police officer. He was raised by American parents who had domestic issues and later got divorced. He has had 18 complaints on official records where two ended up in disciplinary. He also had history being overaggressive when dealing with black clientele while he was working in El Nuevo Rodeo nightclub.
After the crime was committed, as it is a crime against the state, the four officers were fired and taken into custody. According to Andone (2020), they are being held on a bail of $1 million each. Even when the whole world witnessed the injustice that was done against the deceased, he was pleading for his life while pinned on the ground; the accused claimed that the victim was vulnerable due to substance abuse and that he had preexisting medical conditions.
As a police officer, he had the responsibility of serving every citizen despite the race or skin color. Being imprisoned then released on bail should not have happened. Murder is punishable by life imprisonment. Although the prosecutors claim to increase potential sentences for these four officers, it should not be a matter of discussion since evidence from the footage says it all. On the contrary, it is believed that the crime should not be treated as second-degree murder rather manslaughter and third-degree murder or something less than that. This is because the prosecutors will have to prove “depraved indifference” that the accused disregarded the risk and knew the possibility of death occurring during that particular time. It is difficult to establish such a thing making it hard for the prosecutors to convict the accused.
From the Black lives upended by policing (2018), it is clear similar cases have been happening where black lives are taken for granted. For instance, late Tony Robinson, at the age of 19, faced his death by being shot by a police officer. It is high time judicial system addressed such discrepancies.
